Article 1: General Provisions

The e-commerce website of Peggy Sew, a sole proprietorship with registered office at Albert Devuestraat 26, 3020 Herent, VAT BE 0558.950.226, (hereinafter referred to as 'Peggy Sew') offers its customers the opportunity to purchase products from its online store.

These General Terms and Conditions ("Terms") apply to every order placed by a visitor to this e-commerce website (“Customer”). By placing an order through the Peggy Sew online store, the Customer must explicitly accept these Terms, thereby agreeing to the applicability of these Terms, to the exclusion of all other terms. Additional conditions of the Customer are excluded unless they have been previously, explicitly, and in writing accepted by Peggy Sew.


Article 2: Price

All listed prices are expressed in EURO. If VAT is applicable, it will be calculated and added at checkout.

If delivery, reservation, or administrative costs are charged, this will be stated separately.

The price quotation refers exclusively to the articles as described verbally. The accompanying photos are decorative and may contain elements that are not included in the price.

 

Article 3: Offer

Despite the fact that the online catalog and e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer do not bind Peggy Sew. Regarding the accuracy and completeness of the provided information, Peggy Sew is only bound by an obligation of means. Peggy Sew is under no circumstances liable in case of manifest material errors, typesetting, or printing errors.

Colors on photos may differ from real-life colors, which may be influenced by your screen settings.

If the Customer has specific questions about e.g., sizes, colors, availability, delivery time, or delivery method, we ask the Customer to contact Peggy Sew in advance.

The offer is valid while stocks last and can be modified or withdrawn at any time by Peggy Sew. Peggy Sew cannot be held liable for the unavailability of a product. If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.


Article 4: Online Purchases

 To order items, go to the desired item and click on the "order" button. Select the desired quantity and confirm. Do this for all items you want to purchase..

 To complete the order, go to the shopping cart and select a shipping option. Select the delivery country and payment method. Then click on "order these items". 

Enter your details. Fields marked with a * are mandatory. Click on "continue". Check all information and click on "finalize order".

The Customer can choose between the following payment methods:

- Bank transfer

- Bank card

- Paypal

 Peggy Sew is entitled to refuse an order due to a serious shortcoming by the Customer with respect to orders involving the Customer.

 

Article 5: Delivery and Execution of the Agreement

 Once the customer's payment is received by Peggy Sew, the goods will - in principle within 24 hours - be shipped. Payments via bank card, credit card, or Paypal are received immediately.

With payment via bank transfer, it may take a few days before the money is in Peggy Sew's account. If the customer opts to pay via bank transfer, this must be done within 7 calendar days, otherwise, the order will be canceled, and the reserved goods may be resold

 Items ordered via this online store are delivered in Belgium, the Netherlands, Luxembourg, France. If you want to ship to another EU country, please contact Peggy Sew

The delivery time and shipping rates depend on the delivery service. The shipping rates are shown before the final checkout.

Any visible damage and/or qualitative shortcoming of an article or other shortcoming in delivery must be reported immediately by the Customer to Peggy Sew.

 The risk of loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has physically acquired the goods. However, the risk already passes to the Customer upon delivery to the carrier if the carrier was instructed by the Customer to transport the goods and this choice was not offered by Peggy Sew..

 

Article 6: Retention of Title

The delivered articles remain the exclusive property of Peggy Sew until full payment by the Customer.

The Customer undertakes, if necessary, to inform third parties of Peggy Sew's retention of title, e.g., to anyone who would seize the articles that have not yet been fully paid for.

 

Article 7: Right of Withdrawal

The provisions of this article apply only to Customers who purchase articles online from Peggy Sew in their capacity as consumers. ​

 The Customer has the right to withdraw from the agreement within a period of 14 calendar days without giving any reason. .

 The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, physically acquires the goods. ;

 To exercise the right of withdrawal, the Customer must inform Peggy Sew (Albert Devuestraat 26, 3020 Herent, info@peggysew.be) via an unequivocal statement (e.g., in writing by post, fax, or e-mail) of his decision to withdraw from the agreement. .

 To meet the withdrawal deadline, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to Peggy Sew without delay, but in any event no later than 14 calendar days from the day on which he communicated his decision to withdraw from the agreement to Peggy Sew. The Customer is on time if he returns the goods before the 14 calendar days period has expired. ​

 The direct cost of returning the goods is borne by the Customer.

 If the returned product is somehow diminished in value, Peggy Sew reserves the right to hold the Customer liable and claim compensation for any depreciation of the goods resulting from the use of the goods by the Customer beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

 Only articles that are in their original packaging, together with all accessories, instructions, and invoice or proof of purchase can be returned.

 If the Customer withdraws from the agreement, Peggy Sew will reimburse all payments received from the Customer up to that point, including the standard delivery costs, to the Customer within a maximum of 14 calendar days after Peggy Sew has been informed of the Customer’s decision to withdraw from the agreement. In sales contracts, Peggy Sew can wait with the reimbursement until it has received all the goods back, or until the Customer has demonstrated that he has returned the goods, whichever comes first. [

 Any additional costs resulting from the Customer's choice of a different method of delivery than the cheapest standard delivery offered by Peggy Sew will not be reimbursed..

 Peggy Sew will reimburse the Customer using the same means of payment as the Customer used for the initial transaction unless otherwise agreed. 

 The Customer cannot exercise the right of withdrawal for: 

 ·   Service contracts after the full performance of the service

·    The supply of goods made to the Customer’s specifications, or clearly personalized;

·    The supply of newspapers, periodicals, or magazines

·  The supply of digital content not supplied on a tangible medium, such as sewing patterns on digital media (PDF)

 

 Article 8: Privacy

 The controller, Peggy Sew, respects the Belgian law of December 8, 1992, regarding the protection of privacy in the processing of personal data. 

 The personal data you provide will only be used for the following purposes: processing the order, sending newsletters, advertising, and/or marketing purposes. 

 You have a legal right to access and correct your personal data. Subject to proof of identity (copy of identity card), you can obtain a written, dated, and signed request to Peggy Sew (Albert Devuestraat 26, 3020 Herent, info@peggysew.be), free of charge, the written communication of your personal data. If necessary, you can also request to correct the data that would be incorrect, incomplete, or irrelevant.

 In case of the use of data for direct marketing: You can oppose the use of your data for direct marketing free of charge. To do this, you can always contact us (Albert Devuestraat 26, 3020 Herent, info@peggysew.be).

 We treat your data as confidential information and will not pass it on, rent, or sell it to third parties. 

Peggy Sew keeps online (anonymous) visitor statistics to be able to see which pages of the website are visited to what extent.

Article 9: Use of Cookies

Article 10: Impairment Validity - Non-Waiver

If any provision of these Terms is declared invalid, illegal, or null, this will in no way affect the validity, legality, and applicability of the other provisions.

At any time, failing to enforce any of the rights listed in these Terms, or to exercise any right thereof, by Peggy Sew, will never be considered a waiver of such a provision and will never affect the validity of these rights.

 

Article 11: Amendment of Terms

These Terms are supplemented by other terms explicitly referred to, and the general terms and conditions of Peggy Sew. In case of contradiction, these Terms prevail.


Article 12: Proof

The Customer accepts that electronic communications and backups can serve as proof.


Article 13: Applicable Law - Competent Court

Belgian law applies, with the exception of the provisions of private international law regarding applicable law and the Rome I regulation on international sales contracts concerning movable goods.
